These Terms of Use ("Terms") govern your use of the Emerge Linking service provided by Emerge Protocol Ltd. ("Emerge," "we," "us," or "our"). By accessing or using the Emerge Linking functionality, you agree to be bound by these Terms and our Privacy Policy.

1. Who We Are

Emerge Protocol Ltd. is a UK company (Company No. 16142850) with its registered office at 86-90 Paul Street, London EC2A 4NE. We help individuals retrieve and reuse their personal data from major digital platforms ("Gatekeepers") like Google, Meta, ByteDance, and Amazon under the Digital Markets Act (DMA).

2. The Emerge Linking Service

Emerge Linking enables you to connect accounts from Gatekeepers and share selected data with third-party apps or services you activate ("Partners").

You:

• Select the Partner who referred you

• Review and approve the data fields to be shared (e.g., interests, history, preferences)

• Authorise Emerge to retrieve the relevant data via official APIs (e.g., Google Takeout, Meta DMA APIs)

• Consent to data being cleaned, enriched, and forwarded to your selected Partner

3. Eligibility

You must be at least 18 years old and capable of entering into legally binding agreements to use the Services.

4. Your Responsibilities

• Only connect accounts you legally control

• Provide accurate and up-to-date information

• Use the Service in accordance with applicable laws

• Do not misuse the Services for unlawful profiling, scraping, or discrimination

5. Your Rights and Control

• You can revoke access at any time via your connected platform account or the Emerge app

• You can request deletion of your data via in-app controls or by emailing privacy@emergedata.ai

• You may access, correct, export, or delete your personal data as described in our Privacy Policy

6. Data Usage & Sharing

• We act as a data controller under GDPR when we collect and enrich your data

• We do not sell your data or share it with unauthorised third parties

• Data is only shared with Partners you explicitly activate, and for the purposes shown at activation (e.g., loyalty, analytics)

7. Gatekeeper API Compliance

• Your data is accessed only after you authorise via each Gatekeeper’s OAuth flow

• We comply with Google’s Limited Use Requirements and equivalent rules for Meta, Amazon, and ByteDance

• You may revoke consent from your account dashboard at any time

8. Security and Hosting

• Data is stored in secure AWS data centres in the EU (Paris & Frankfurt)

• We apply encryption, access control, and regular security audits (see Privacy Policy §6)

9. Suspension and Termination

We may suspend or terminate your access if:

• You violate these Terms

• We suspect fraudulent or unlawful activity

• Required by law or regulation

10. Disclaimers

• We provide the Services "as-is" without warranties

• We are not responsible for the accuracy of third-party data

• We do not provide legal, health, or financial advice

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential losses.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to you via email or in-app notice. Your continued use of the Services after changes means you accept the new Terms.
